Day three of the application saw the legal representative of the Applicant Number Two questioning the validity of the so–called confession made by the applicants. The investigating officer (IO) in the matter, Nkululeko Mtati has maintained that all the accused in the matter have confessed to their roles in the killing of Tete. Both applicants have cited medical and personal circumstances for their release on bail. The 53-year-old made a brief appearance in the Cullinan Magistrate’s Court outside Pretoria on Tuesday. “We can say that we are happy and not happy, there’s a lot of things in our minds, we only seek justice for our kid. I have faith in the justice system, it’s just that I am hurting and feel like crying when I see that man, I just have to contain myself. ” Tshepang’s aunt confirmed that his burial will be on Wednesday.

Legabe was arrested last month in Pretoria following a lengthy investigation. Legabe faces charges of housebreaking and theft, as well as an additional charge relating to dealing in drugs. Legabe’s affidavit was read by his lawyer Hendrik Potgieter who informed the court that his client alleges that he was tortured and forced to confess.

“Instead of going to a police station he took me to an office in Pretoria town where I was questioned and then arrested for the Port Shepstone break-in. I was tortured to implicate police officers in the break-in. I was in severe pain during this torture and I denied any knowledge of the crime committed. Asanda Pakade has argued that his client was not given an opportunity to go through his statement. The legal representatives of Applicant Number Two put to the investigating officer that there is no evidence that he has given to prove that he is the middleman behind the hit.
Pakade further stated that the IO has no evidence that his client received any form of payment from Applicant Number One who is the alleged to be the mastermind. Applicant Number Two says he is a married man and could potentially lose his job if kept in custody.
